A fines de junio \u00faltimo, la Justicia sobresey\u00f3 Patricia Ana Scheuer<\/b>, la actriz y empresaria gastron\u00f3mica detenida en las primeras horas del A\u00f1o Nuevo<\/b><\/span> de 2025 por atropellar y matar a un turista brasile\u00f1o <\/b>y herir gravemente a su pareja en la esquina de la avenida Del Libertado y Alvear mientras conduc\u00eda su Nissan Kick. <\/p>\n

La decisi\u00f3n, tomada por el juez Mart\u00edn Peluso<\/b> tras una extensa investigaci\u00f3n a cargo del secretario Diego Villanueva<\/b>, determin\u00f3 que \u201cal momento del hecho, curs\u00f3 un episodio de estado de inconciencia<\/b>, que excluy\u00f3 toda conducta voluntaria\u201d, un literal apag\u00f3n <\/b>en el cerebro. <\/p>\n

Ayer mi\u00e9rcoles, el sobreseimiento de Scheuer<\/b> fue confirmado por la Sala I de la C\u00e1mara de Apelaciones<\/b><\/span>, tras una presentaci\u00f3n de las querellas de las v\u00edctimas, Fernando Amorim y Cleusa Nunes Pombo. <\/p>\n

En un fallo de 18 p\u00e1ginas al que accedi\u00f3 Infobae<\/b>, los jueces Pablo Lucero y Rodolfo Pociello Argerich afirmaron que \u201cel evento investigado se produjo en un contexto de ausencia de control finalista <\/b>por parte de la encausada, luego de descartar todas las hip\u00f3tesis alternativas y de verificar que no existi\u00f3 conducta previa voluntaria o culposa\u201d y que \u201cno se verific\u00f3 una acci\u00f3n penalmente relevante atribuible a Patricia A. Scheuer\u201d.<\/b><\/p>\n

Durante la investigaci\u00f3n, se revel\u00f3, por ejemplo, que Scheuer sufr\u00eda de \u201cepilepsia focal de causa estructural\u201d<\/b>, un diagn\u00f3stico realizado en la cl\u00ednica FLENI.<\/p>\n

El secretario Villanueva investig\u00f3 cada \u00e1ngulo. Se indag\u00f3 en la historia cl\u00ednica de Scheuer y se perit\u00f3 el iPhone <\/b>de la acusada, para intentar determinar si empleaba el aparato al momento del accidente. La pericia al aparato, realizada en dos ocasiones por la Polic\u00eda de la Ciudad, dio negativo en este sentido.<\/b><\/p>\n

En sus apelaciones, las querellas<\/b> -Gabriel Amorim, hijo de Fernando, fue representado por los abogados Facundo Orazi y Agust\u00edn Biancardi- afirmaron que la decisi\u00f3n de Peluso era prematura <\/b>y que no se pod\u00eda \u201csobreseer por duda\u201d. <\/p>\n

Los camaristas determinaron que quedaron \u201celiminadas todas las causales alternativas del suceso\u201d como el \u201cuso del celular, conducci\u00f3n bajo sustancias, exceso de velocidad, condiciones clim\u00e1ticas<\/b> y del lugar, falta de anteojos, distracci\u00f3n o v\u00ednculo causal con la declaraci\u00f3n administrativa\u201d.<\/p>\n

Para Lucero y Pociello Argerich, por otra parte, fue determinante la pericia vial que analiz\u00f3 el trayecto final de Scheuer en su Nissan Kick. La pericia muestra a la acusada \u201ccontinuando en l\u00ednea cuasi recta hasta colisionar el cord\u00f3n cuneta derecho y subir a la plazoleta<\/b>, es decir, no copiando el giro hacia la izquierda que presenta la calzada en esa zona y sin evidenciarse signos de maniobras elusivas\u201d.<\/p>\n

El descargo de la empresaria<\/h2>\n

Los jueces consideraron que esta pericia vial era condicente con la declaraci\u00f3n de Scheuer.<\/p>\n

La empresaria afirm\u00f3 que \u201cven\u00eda despacio en el auto, hab\u00eda pocos autos, recuerdo que vi el Museo de Bellas Artes, y despu\u00e9s no puedo recordar absolutamente nada<\/b>; lo siguiente es que escucho como un estruendo, no s\u00e9 si pis\u00e9 yo el freno o se par\u00f3 el auto, no lo puedo saber con certeza. Cuando vuelvo sobre m\u00ed, veo el airbag, y humo o polvo…\u201d<\/p>\n

As\u00ed, los camaristas sintetizaron: \u201cLa acci\u00f3n penalmente relevante exige direcci\u00f3n consciente del curso causal<\/b>, y la prueba reunida no permite afirmar que la imputada ejerciera dicho control<\/b> en los momentos previos al suceso\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
