homicidio doblemente agravado: por el v\u00ednculo de pareja y por haber sido cometido mediando violencia de g\u00e9nero<\/b><\/span>.<\/b> El fallo tambi\u00e9n contempl\u00f3 una condena adicional por desobediencia a funcionario p\u00fablico<\/b>, dado que Garc\u00eda ten\u00eda vigente una prohibici\u00f3n de acercamiento a la v\u00edctima.<\/p>\nLa sentencia fue dictada en l\u00ednea con el pedido presentado la semana pasada por la fiscal interina<\/b> Mar\u00eda Luisa Piqu\u00e9<\/b>, a cargo de la Fiscal\u00eda N\u00b0 18<\/b> ante los Tribunales Orales en lo Criminal y Correccional.<\/b> Seg\u00fan se inform\u00f3, los fundamentos <\/b>completos de la resoluci\u00f3n judicial ser\u00e1n dados a conocer el pr\u00f3ximo 2 de julio<\/b>.<\/p>\n
En un caso que estremeci\u00f3 al barrio porte\u00f1o de Villa Lugano<\/b>, la investigaci\u00f3n determin\u00f3 que el femicidio ocurri\u00f3 durante la ma\u00f1ana del 24 de mayo de 2024<\/b>, en el domicilio de la v\u00edctima, ubicado sobre la calle<\/b> Nicol\u00e1s Dezcalzi al 5500<\/b>. De acuerdo con la reconstrucci\u00f3n de los hechos expuesta por la fiscal\u00eda, Garc\u00eda at\u00f3 de manos y piernas a Mariel, la coloc\u00f3 sobre la cama y le impidi\u00f3 respirar, provocando su muerte por asfixia<\/b>. Se destac\u00f3 que la v\u00edctima hab\u00eda denunciado previamente episodios de violencia de g\u00e9nero<\/b> y exist\u00eda una orden de restricci\u00f3n vigente al momento del crimen.<\/p>\n
Para los magistrados, result\u00f3 determinante el v\u00ednculo entre la v\u00edctima y el agresor, as\u00ed como el contexto de violencia de g\u00e9nero sostenido en el tiempo. El tribunal consider\u00f3 probado que Garc\u00eda viol\u00f3 la prohibici\u00f3n de acercamiento<\/b> dispuesta en el marco de una causa previa por denuncias de Mariel. <\/p>\n
El tribunal resolvi\u00f3, adem\u00e1s, absolver a Garc\u00eda por los cargos de abuso sexual y amenazas coactivas<\/b> que tambi\u00e9n figuraban en la acusaci\u00f3n, al considerar que no se reunieron pruebas suficientes para sostener esos episodios.<\/p>\n
En cuanto a las medidas reparatorias, el tribunal dispuso que la Administraci\u00f3n Nacional de la Seguridad Social (ANSES)<\/b> reciba la resoluci\u00f3n para que pueda tramitarse la reparaci\u00f3n econ\u00f3mica<\/b> prevista en la Ley N\u00b027452 \u201cBrisa\u201d<\/b>. Esta ley establece un r\u00e9gimen especial de compensaci\u00f3n para hijos e hijas de v\u00edctimas de femicidio<\/b>. De este modo, la hija de Mariel Jim\u00e9nez podr\u00e1 acceder a la protecci\u00f3n<\/b> prevista para menores afectados por hechos de violencia extrema.<\/p>\n
La acusaci\u00f3n sostuvo que, tras cometer el crimen, Garc\u00eda llam\u00f3 por tel\u00e9fono a sus hermanos y les confes\u00f3 que \u201cse hab\u00eda mandado una macana\u201d.<\/b> Cuando sus familiares llegaron al domicilio, el condenado traslad\u00f3 el cuerpo de Mariel,<\/b> envuelto en una frazada, hasta el Centro de Salud y Acci\u00f3n Comunitaria N\u00b03<\/b>. Esta secuencia fue registrada por una c\u00e1mara del Centro de Monitoreo Urbano de la Polic\u00eda de la Ciudad<\/b>, lo que permiti\u00f3 reconstruir parte del recorrido.<\/p>\n
Ya en el centro de salud, una m\u00e9dica detect\u00f3 signos de violencia en el cuerpo de la v\u00edctima y dio aviso al<\/b> 911<\/b>. Al llegar la Polic\u00eda, la madre de Garc\u00eda declar\u00f3 que su hijo \u201chab\u00eda encontrado as\u00ed\u201d a la joven. Poco despu\u00e9s, el padre del acusado se present\u00f3 en el lugar y manifest\u00f3 que su hijo \u201cse hab\u00eda mandado una cagada y que se ven\u00eda a entregar\u201d.<\/b><\/p>\n

De acuerdo con lo informado durante el debate oral, el propio Garc\u00eda relat\u00f3 los hechos a un inspector policial<\/b> durante su traslado a la Comisar\u00eda Vecinal N\u00b08<\/b>, aportando detalles sobre la mec\u00e1nica del homicidio.<\/p>\n
Seg\u00fan la fiscal\u00eda, el crimen evidenci\u00f3 un patr\u00f3n de control y hostigamiento ejercido por Garc\u00eda sobre Mariel.<\/b> Testigos que declararon en el juicio se\u00f1alaron que el condenado era \u201cposesivo\u201d y que la v\u00edctima \u201cviv\u00eda con miedo\u201d.<\/b><\/p>\n
En mayo de 2022, Mariel hab\u00eda denunciado a Garc\u00eda por episodios de violencia, lo que motiv\u00f3 la disposici\u00f3n de un bot\u00f3n antip\u00e1nico y la asignaci\u00f3n de custodia policial. Sin embargo, la fiscal\u00eda detall\u00f3 que el acusado la presion\u00f3 para que retirara las acusaciones. Como parte del proceso judicial, se orden\u00f3 una consigna policial en el domicilio y la prohibici\u00f3n de contacto.
