En concreto, cuestionan la validez de las pruebas y el criterio del juez Paz Almonacid<\/b> para dictar el fallo.<\/p>\n

El caso se remonta a marzo de 2024, cuando una joven periodista denunci\u00f3 a los cuatro futbolistas que entonces integraban el plantel de V\u00e9lez Sarsfield por un supuesto abuso en un hotel de San Miguel de Tucum\u00e1n. El juez Almonacid resolvi\u00f3 el sobreseimiento al considerar que el hecho no constitu\u00eda delito<\/b>, tras rechazar el pedido de nulidad de pruebas realizado por la querella.<\/p>\n
Las defensas –Florencia Abdala<\/b> y Camilo Atim<\/b> representan a Bobadilla; Jos\u00e9 Mar\u00eda Molina<\/b>, Ernesto Garc\u00eda Biagosch<\/b> e Ileana Battaglia<\/b>, a Cufr\u00e9 y Osorio; y Ernesto Baaclini<\/b> es defensor de Sosa-, por su parte, argumentaron que las pericias demostraban una relaci\u00f3n consentida, mientras que la representaci\u00f3n de la denunciante sostuvo que la valoraci\u00f3n de la prueba fue arbitraria y que muchas evidencias no fueron tomadas en cuenta. La querella apel\u00f3 la resoluci\u00f3n y as\u00ed la causa lleg\u00f3 a esta instancia.<\/p>\n
Fuentes del caso explicaron a Infobae <\/b>que la admisibilidad del recurso presentado por la querella no significa un fallo de fondo ni implica una reapertura<\/b>. El tr\u00e1mite es parte de cualquier apelaci\u00f3n en la provincia: si el recurso se presenta en tiempo y forma, el tribunal lo admite para luego analizar los argumentos principales.<\/p>\n

En este contexto, y ante versiones err\u00f3neas que circularon, cabe aclarar que la causa siempre se mantuvo abierta y no estar\u00e1 cerrada hasta que la resoluci\u00f3n alcance el car\u00e1cter de firmeza<\/b>. De hecho, el expediente podr\u00eda llegar a otras dos instancias superiores: la Corte Suprema de Tucum\u00e1n y, eventualmente, la Corte Suprema de Justicia de la Naci\u00f3n.<\/b><\/p>\n
As\u00ed las cosas, por ahora, el expediente sigue en etapa de revisi\u00f3n y las partes se preparan para la continuidad de las audiencias, donde se definir\u00e1 si se confirma el sobreseimiento o si la causa tiene un nuevo cap\u00edtulo judicial.<\/p>\n
Otro punto a aclarar en esta situaci\u00f3n es que el Ministerio P\u00fablico Fiscal no recurri\u00f3 la decisi\u00f3n de sobreseimiento respecto de los ex jugadores, por lo que su postura fue interpretada como un consentimiento a favor del fallo original<\/b>.<\/p>\n
